Abstract |
In modern conditions, the problem of economic efficiency of criminal law norms is becoming more and more important. This is due to the crisis in the global economy and the growing number of economic crimes. Particularly relevant in this regard is the use of tools of modern economic science to increase the effectiveness of criminal law regulation. Economic reasons already lie at the basis of sources of law: legal customs, legal acts and judicial precedents. Formed in the west, the school of economic analysis of law aims to study the role of legal norms in maximizing income and minimizing economic costs. G. S. Bekker in his program article “Crime and Punishment: an Economic Approach” formulated the main issues in the field of criminal law that can be resolved from the standpoint of modern economic analysis. Criminal law norms and the entire law enforcement system will begin to function efficiently from an economic point of view if the amount of material proceeds from crime is returned to the budget that exceeds the costs of the state and society for the maintenance of the entire law enforcement system. It is important in society to create such conditions that committing crimes was not profitable, including economically. The fines system is perhaps the most effective way to combat corruption. Fines, as a system of criminal punishment, are also effective in the sense that they are more humane in comparison with those sanctions that involve various types of physical impact or restriction of freedom by the logic of development of the global market economy in recent years. |
